What is Process


Legal Process (or sometimes "Process"), refers to the proceedings in any civil lawsuit or criminal prosecution and, particularly, describes the formal notice or writ used by a Court to exercise jurisdiction over a person or property. Such Process is usually "served" upon a party, to compel that party to come to court, and may take the form of a summons, mandate, subpoena, warrant, or other written demand issued by a Court.

Service Methods


Your Process may be served by various methods, the most important part of Process Serving is making sure it is done correctly.


1.  Personal Service.  Where the documents (Process) are delivered directly to the named party.  This is always the most desired method of service.


2.  Substituted Service.  Where the Process is left at the residence or place of business of the named party.  This is valid after diligent attempts have been made first for personal service.  Substituted Service also requires that a copy of the documents must also be mailed after the substituted service is complete to be effective.


3.  Posting & Mailing.  Where the Process is posted in the most conspicuous place that is most likely to lead to the named party finding them.  (This is only allowable for the posting of Landlord & Tenant Notices after having first attempted Personal and Substituted service first.) 


Exception: After diligent efforts have been made to serve Unlawful Detainer (Eviction Papers) you may apply to the Court for an Order allowing the Posting and Mailing pursuant to CCP § 415.45.


4.  Publication.  When you are unable to serve by any other means and after diligent efforts to locate the party have been exhausted, the serving party may apply to the Court for an order to serve by publication.  This is the least favorable method of service.
